Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of Retro Drop (the “platform,” “we,” or “us”). By creating an account or otherwise using the platform, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the platform.
⚠ Photosensitivity & Health Warning
A very small percentage of people may experience seizures, blackouts, or other symptoms when exposed to flashing lights, rapidly changing images, or certain patterns, even with no prior history of epilepsy. Some games on Retro Drop — including, for example, Gravity Flip— contain flashing lights and rapidly shifting visuals.
Play in a well-lit room, sit back from the screen, and take a 10–15 minute break every hour. Stop playing immediately and consult a doctor if you experience dizziness, altered vision, eye or muscle twitches, disorientation, involuntary movements, or loss of awareness. If you or anyone in your family has a history of seizures, consult a doctor before playing. You play at your own risk, and by using the platform you acknowledge and accept this warning.
1. Eligibility
You must be at least 13 years of age to create an account. By signing up you confirm that you meet this age requirement and that the date of birth you provide is accurate. Accounts created on behalf of anyone under 13 will be removed when we discover them. Where local law sets a higher minimum age for online services, that higher minimum applies to you.
2. Your Account
You are responsible for:
- The accuracy of the information you provide at signup
- Keeping your password secure and not sharing it with anyone
- All activity that occurs under your account, whether or not you authorized it
- Notifying us promptly if you believe your account has been compromised
You may have only one active account. Creating additional accounts to evade a suspension, ban, anti-cheat decision, or rate limit is prohibited and grounds for permanent termination.
3. Username and Display Name
Your username and display name appear publicly on leaderboards, tournament standings, and your profile. You may not choose a username or display name that is offensive, hateful, harassing, sexually explicit, deceptive (for example, impersonating another person or a Retro Drop staff member), or that infringes someone else’s rights. We may reject a name at signup, and may suspend or remove an account whose username or display name violates these rules.
4. License to Use the Platform
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and play the games on the platform for your own non-commercial entertainment. This license does not include any right to copy, modify, redistribute, decompile, reverse-engineer, scrape, frame, or commercially exploit any part of the platform or its content.
5. Acceptable Use
When using Retro Drop, you agree not to:
- Use bots, macros, scripts, modified clients, or any automated means to play or to submit scores
- Tamper with, replay, or otherwise manipulate game session tokens or API requests
- Interfere with anti-cheat enforcement, including by attempting to disable, evade, or reverse-engineer it
- Probe, scan, or test the vulnerability of the platform, or breach any security or authentication measure
- Use any form or field on the platform (such as your display name or a support or data request) to send spam, phishing, or abusive content
- Attempt to gain access to accounts, data, or systems you are not authorized to access
- Use the platform to violate any applicable law, regulation, or third-party right
6. Fair Play and Anti-Cheat
Scores submitted to public leaderboards must be earned through normal, manual gameplay in an unmodified browser. Our anti-cheat system inspects each submission for integrity using multiple independent signals, including HMAC-signed game session tokens, server-side coin calculation, statistical outlier detection, and submission velocity limits. Submissions that fail validation may be rejected, flagged, or excluded from leaderboards. We may also manually review gameplay and remove individual scores we determine to be invalid, and a ban for cheating may include removing all of the account’s scores from public leaderboards. Accounts that accumulate repeated flags may be automatically suspended or permanently banned. Anti-cheat decisions are final and not negotiable; in good-faith cases you may appeal once through the support contact in your account settings.
7. Tournaments
From time to time we run tournaments across selected games. Tournament rules — scoring method, duration, eligible games, and any prizes — are shown on the tournament page when you enter. During an active tournament, daily new-game drops pause and the schedule resumes after the tournament ends. We may modify, suspend, or end a tournament at any time, and we may disqualify entries that violate these Terms or the tournament’s posted rules. Unless explicitly stated on the tournament page, no monetary prize is offered.
8. Virtual Items and Currency
Coins, fruit, avatars, trophies, XP, levels, streaks, and any other in-game items (collectively, “Virtual Items”) have no real-world monetary value, are not your property, and are licensed to you for personal use on the platform only. Virtual Items cannot be sold, transferred between accounts, redeemed for cash, or exchanged outside the platform. We may add, change, devalue, or remove Virtual Items at any time without compensation. Coins are calculated server-side from your gameplay; client-reported coin values are not accepted. We may also, at our discretion, grant promotional Virtual Items or complimentary Pro memberships (for example, as goodwill, giveaways, or support adjustments); these carry no cash value, confer no ongoing entitlement, and may be adjusted or revoked if granted in error or obtained through prohibited activity.
9. Pro Subscriptions
9.1 What Pro includes
A Pro subscription unlocks the vault of past daily games, lets you favorite games, and grants certain quality-of-life perks (such as periodic streak shields). Specific Pro benefits are listed on the pricing page and may change over time.
9.2 Billing
Pro is offered as a recurring subscription billed monthly or annually at the rate shown on the pricing page at the time you subscribe. You authorize us and our payment processor to charge your chosen payment method at the start of each billing period until you cancel. Prices may change with notice for future billing periods.
9.3 Cancellation
You may cancel from your account settings at any time. Cancellation takes effect at the end of the current billing period — you keep Pro access until then. We do not provide pro-rated refunds for partial billing periods. Where required by law (for example, certain EU consumer protections), you may be entitled to a refund within a statutory window; those rights are unaffected by this Section.
9.4 Pause and reactivation
If you pause your subscription, billing stops and you keep full Pro access for the pause period (currently up to 30 days). Reactivate any time to resume normal billing at the then-current price. If you don’t reactivate, the pause converts to a cancellation and Pro access continues until the end of the period you already paid for, after which the account returns to the free tier.
9.5 Win-back and promotional offers
We may offer promotional discounts to canceled subscribers. Promotional terms are shown with the offer; promotional pricing applies only for the period stated and reverts to the standard rate afterwards.
10. Game Sessions and Score Integrity
Each play begins with a one-time, HMAC-signed session token issued by the server. Token replay, forgery, or tampering invalidates any score submitted with that token and may trigger an anti-cheat flag. The platform stores only your best score per game (replays with lower scores are still counted as plays but do not overwrite your personal best).
11. Termination
You may terminate your account at any time from the account settings page; deletion is permanent and removes your profile, scores, tournament entries, trophies, avatars, streak, and other personal data, subject to the retention described in our Privacy Policy. We may suspend or terminate accounts that, in our reasonable judgment, violate these Terms, engage in cheating, evade prior enforcement, misrepresent the account holder’s age, or harm the platform or other players. We also reserve the right to terminate accounts that remain inactive for an extended period. On termination, all licenses granted to you under these Terms end immediately.
12. Intellectual Property
The platform, its games, code, graphics, sound, user interface, and branding are owned by us or our licensors and are protected by intellectual-property laws. Aside from the limited license in Section 4, no rights are transferred to you. You retain ownership of any content you provide, such as the username you choose (from which your public display name is generated), and you grant us a worldwide, royalty-free license to host, display, and distribute it as needed to operate the platform — for example, showing your name on a leaderboard.
13. Disclaimers
The platform is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that your scores, virtual items, streak, or account data will never be lost, corrupted, or rolled back.
14. Limitation of Liability
To the maximum extent permitted by law, Retro Drop and its affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost virtual items, or loss of goodwill arising out of or related to your use of the platform, even if we’ve been told such damages are possible. Our total liability for any claim related to the platform is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) twenty U.S. dollars. Some jurisdictions don’t allow these limits, in which case they apply only to the extent permitted by local law.
15. Indemnification
You agree to defend, indemnify, and hold harmless Retro Drop and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the platform, your violation of these Terms, or your violation of any third-party right.
16. Modifications to the Service
The platform is under active development. We may add, change, remove, or temporarily suspend any game, feature, leaderboard, tournament, virtual item, or Pro benefit at any time without notice and without liability. Daily-drop schedules may shift in response to events on the platform, such as ongoing tournaments.
17. Changes to These Terms
We may update these Terms from time to time to reflect new features, changes in our data practices, or legal and regulatory requirements. For material changes— such as changes to how we collect, use, share, or retain your data, to Pro billing, to dispute resolution, or to your rights under these Terms — we will provide notice at least 30 days before the change takes effect by:
- Posting the updated Terms here with a new “Last updated” and “Effective” date
- Displaying an in-app banner or notice summarizing the key changes in plain language
- Emailing registered users a short summary (3–5 bullets) with a link to the full Terms
Non-material changes (such as typo fixes, clarifications, or formatting updates) may take effect without advance notice but will still be reflected in the “Last updated” date. If you do not agree to a change, you may close your account before the effective date; continued use of the platform on or after the effective date constitutes acceptance of the updated Terms.
18. Your Data and Privacy Rights
Our Privacy Policy describes what personal data we collect, the purposes we use it for, who we share it with, and how long we keep it. Depending on where you live, applicable law — including the EU/UK General Data Protection Regulation (GDPR), the California Consumer Privacy Act as amended by the CPRA (CCPA/CPRA), and similar laws — may give you the right to:
- Access the personal data we hold about you
- Correct inaccurate data
- Delete your account and associated data (subject to limited legal retention)
- Receive a portable copy of your data
- Object to or restrict certain processing, including for marketing
- Withdraw consent where processing is based on consent
- Lodge a complaint with your local data-protection authority
You can delete your account and data directly from your account settings, and exercise your other rights — including receiving a copy of your data — by contacting us through the support channel listed there. We will respond within the timeframes required by applicable law.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Texas will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the platform, except where applicable consumer-protection law gives you a non-waivable right to bring a claim in your home jurisdiction.
20. Regional Variations
Some clauses in these Terms apply differently depending on where you live. If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction whose mandatory consumer- protection laws conflict with any provision of these Terms (for example, statutory withdrawal rights for Pro subscriptions, statutory warranties, or limits on liability waivers), those local mandatory rules prevail to the extent of the conflict, and the remainder of these Terms continues to apply.
21. Miscellaneous
These Terms are the entire agreement between you and Retro Drop concerning the platform and supersede any prior agreement on the same subject. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
